What is a Domestic Violence Order?
A Domestic Violence Order (DVO) is a civil order made by a Queensland Magistrates Court to protect a person from further domestic violence. A DVO is sometimes called a protection order. There are two main types:
- Temporary Protection Order — short-term protection while the matter is before the court.
- Protection Order — a final order, usually in place for five years.
Standard conditions usually require the respondent to be of good behaviour and not commit domestic violence. Additional conditions can include no-contact, exclusion from a residence, and conditions about children. Breaching a DVO is a criminal offence in Queensland.
You can read more on the Queensland Courts domestic and family violence page.
How domestic violence lawyers Brisbane can help
A qualified Brisbane domestic violence lawyer can:
- Explain the law and what a DVO means for you.
- Help you prepare a DVO application or response.
- Represent you in the Magistrates Court.
- Negotiate consent orders without admissions, where appropriate.
- Advise on parenting, property and family law implications.
- Refer you to safety planning and counselling services.
What does the court consider?
The Magistrates Court considers whether a relevant relationship exists, whether domestic violence has occurred, and whether an order is necessary or desirable to protect the aggrieved person. The court can consider patterns of behaviour, not just single incidents.
Coercive control in Queensland
Coercive control is a pattern of behaviour used to dominate, isolate or frighten another person. It can include emotional abuse, financial control, monitoring, threats and isolation from friends and family. From 2025, coercive control is recognised as a standalone criminal offence in Queensland.
You can read more on the Queensland Government coercive control information page.
Choosing a domestic violence lawyer in Brisbane
When choosing a Brisbane domestic violence lawyer, consider:
- Experience with DVO and family violence matters in the Queensland Magistrates Court.
- A clear, written fee structure.
- Whether you feel safe and listened to in the first meeting.
- Whether the lawyer can refer you to support services if needed.
It is okay to speak to more than one lawyer before deciding. If cost is a barrier, ask about Legal Aid Queensland or a community legal centre.
